Terms of service
These terms of service apply to all contracts concluded via scraper-api.com between B A Media Group FZE LLC (hereinafter the “Provider”) and the customer, reachable at contact@bamg.ae.
1. Scope and contracting party
These terms apply in the version valid at the time of the order to all contracts concluded via scraper-api.com. The customer's contracting party is the Provider, whose full details can be found in the legal notice.
2. Subject matter
The Provider offers a programmatic API that returns publicly available data from third-party social media and directory platforms. The specific scope, endpoints and quotas result from the respective product description at the time of purchase. Access is metered in credits, where one API request consumes one credit.
3. Conclusion of contract
The presentation of the plans is an invitation to place an order. By completing checkout, the customer makes a binding offer. The contract is concluded upon confirmation or successful receipt of payment. The customer receives a confirmation by email.
4. Credits, prices and payment
Access is purchased as non-expiring credits; one request consumes one credit. Prices are stated at the time of purchase as one-time charges.
Payment is made in advance via the payment service provider Stripe. Credits are granted after successful receipt of payment. An invoice is provided by email.
5. Acceptable use
The customer is solely responsible for the lawful use of the API and the retrieved data and warrants compliance with applicable law, including data-protection and the third-party platforms' terms.
Prohibited in particular are: circumventing credit metering or rate controls; reselling raw access; using the data to harass, de-anonymise or harm individuals; and any unlawful, infringing or abusive purpose. API keys are confidential and must not be shared.
6. Availability
The Provider endeavours to keep the API available but does not guarantee uninterrupted availability. Maintenance, third-party platform changes and force majeure may cause temporary interruptions. As paid plans run without artificial rate limits, fair-use safeguards against abuse remain reserved.
7. Warranty and liability
The Provider delivers the service with due care. Because the data originates from third-party sources that may change or restrict access at any time, no guarantee is given for completeness, accuracy or continued availability of any specific endpoint. The Provider is liable without limitation for intent and gross negligence and for injury to life, body or health; for simple negligence only upon breach of a material contractual obligation, limited to the foreseeable damage typical for the contract. Any further liability is excluded.
8. Term
Contracts for credit purchases are fulfilled upon delivery of the purchased credits; a single purchase does not establish a continuing obligation unless expressly agreed.
9. Final provisions
The law at the Provider's registered office applies, excluding the UN Convention on Contracts for the International Sale of Goods; mandatory consumer-protection provisions of the customer's habitual residence remain unaffected. Should individual provisions be invalid, the remaining provisions remain unaffected. Amendments require text form.
10. Third-party trademarks
All third-party names, brands and logos are the property of their respective owners and are used solely for descriptive purposes. The Provider is in no way affiliated with, endorsed or authorised by these platforms.
